Terms & Conditions 1.1. Our Purpose Our services provide our Users (defined below) with the ability to easily create a functional and striking online presence, manage and promote their businesses, content, and ideas, and have an exceptional experience in the process, even with little knowledge of technology or design. As described below, we offer various tools and resources to our users so they can create, publish, and use impressive websites, online e-commerce platforms, newsletters, galleries, video players, apps, and other online and mobile services and tools. The functionalities, websites, and online and mobile platforms created by Users are collectively referred to in this document as "User Platforms." StoreFlasher offers online and mobile services and tools that allow the User to create, manage, and/or use their own online and mobile presence. 1.2. Legal Agreement These StoreFlasher Terms of Use ("Terms of Use"), together with additional terms applicable to certain services and features of ours (as indicated on the StoreFlasher website) (hereinafter referred to as the "StoreFlasher Site" and collectively "StoreFlasher Terms"), comprise all the terms and conditions governing each visitor or User (hereinafter referred to as "User" or "you") of the StoreFlasher Site, the StoreFlasher mobile application (the "StoreFlasher App"), and/or any other service, application, or feature offered by StoreFlasher related to these, except as otherwise provided by StoreFlasher (all services made available through the StoreFlasher Site or the StoreFlasher App, collectively referred to as "StoreFlasher Services" or simply "Services"). For clarity, the StoreFlasher Services (as defined in these Terms of Use) do not include services, applications, features, or components created, developed, connected, or offered by a StoreFlasher User, even if presented on the StoreFlasher Site or the StoreFlasher App. The StoreFlasher Terms constitute a binding and valid contract between the company StoreFlasher Ltda. and its affiliates and subsidiaries worldwide ("StoreFlasher" or "we") and you regarding the use of any StoreFlasher Services. Therefore, please read them carefully. You may visit and/or use the StoreFlasher Services and/or the StoreFlasher App only if you fully agree with the StoreFlasher Terms, and by using and/or registering for any StoreFlasher Services, you declare that you affirmatively and knowingly consent to these Terms of Use and to any other applicable StoreFlasher Terms for your use of StoreFlasher Services. If you have not read, fully understood, or do not agree with the StoreFlasher Terms, you must immediately exit the StoreFlasher Site and avoid or cease any use of StoreFlasher Services or the StoreFlasher App. By using our services, you also acknowledge having read our Privacy Policy, available in our Privacy Policy. By visiting our site or using our apps and/or services, you are entering into a legal contract with us, composed of these Terms of Use and our additional legal terms for service provision. By using our services, you agree to these terms and acknowledge having read our Privacy Policy. If you do not agree with all of our terms, you may not use our services. 1.3. User Account To access and use certain sections and features of the StoreFlasher Services, you must first register and create an account on StoreFlasher ("User Account"). Creating a User Account or purchasing Paid Services (as defined in Section 5 below) can be done directly through the StoreFlasher Site or through authorized third parties selling StoreFlasher subscriptions for User Accounts and other Paid Services ("Reseller") under a separate agreement with StoreFlasher ("Reseller Agreement"). If you register with the StoreFlasher Services or purchase Paid Services through a Reseller (hereinafter referred to as "Reseller User"), consider the following: These Terms of Use are applicable in addition to any agreements between you and the Reseller and govern your use of the StoreFlasher Services. With regard to the agreement between you and StoreFlasher, for your relationship with StoreFlasher and unless otherwise stated by StoreFlasher, you will be considered a User, not a Reseller User. Your Reseller is not an agent of StoreFlasher, has no authority to make statements, representations, or commitments on behalf of StoreFlasher, and cannot bind StoreFlasher in any way. The payment you make to your Reseller is considered a payment made by you directly to StoreFlasher. StoreFlasher is not obligated to provide any kind of support to you, a Reseller User. Support, if available, will be provided to you at the sole discretion of StoreFlasher. 1.4. Use by Minors The StoreFlasher Services are not intended for individuals under 13 years of age. If you are under 13 years old, you may not register a User Account or provide any personally identifiable information through the StoreFlasher Services. If you are between 13 and 17 years old, you may only use the StoreFlasher Services and provide personally identifiable information provided your parent/guardian reads and agrees to these Terms of Use on your behalf. Any access or use of the StoreFlasher Services by individuals under 13 years of age without appropriate consent is strictly prohibited and in violation of these Terms of Use. 1.5. Updates to StoreFlasher Terms StoreFlasher reserves the right, at its sole discretion, to change, modify, add, or remove any portions of the StoreFlasher Terms at any time, without prior notice. We recommend that you periodically review the StoreFlasher Terms to be aware of changes. Your continued use of the StoreFlasher Services after the posting of any changes to the StoreFlasher Terms will signify that you have accepted such changes. If you do not agree with the amended StoreFlasher Terms, you should discontinue your use of the StoreFlasher Services.
